Emergency Order Regarding Juvenile Curfew

TO ALL RESIDENTS AND PERSONS WITHIN THE MUNICIPALITY OF THE TOWNSHIP OF LONG BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY AND TO ALL DEPARTMENTS OF THE MUNICIPAL GOVERNMENT OF THE TOWNSHIP OF LONG BEACH

 WHEREAS, pursuant to the powers vested by Chapter 251 of the laws of 1942, as amended and supplemented, N.J.S.A. App. A: 9-30, et seq.; N.J.S.A. 40:48-1, et seq.; and all applicable statutory law and regulations, as well as the Chapter 105 of the Township Code, the Township of Long Beach (“Township”) declared on March 24, 2020, that a local disaster/emergency exists within by and through the required authorization of the Director of Public Safety and the Emergency Management Coordinator; and

WHEREAS, the aforesaid laws and declaration of emergency authorize the promulgation of such orders, rules, and regulations are necessary to meet the various problems which have or may occur due to such an emergency, and

WHEREAS, continued social distancing and efforts to limit close interaction by and among the public, as well as the Township employees, to fullest extent practical and feasible is of paramount importance; and

WHEREAS, prior events established that juveniles had been accessing the beaches during the evening and night hours in a manner that violates the aforesaid social distancing requirements, requirements which are absolutely required in order to protect the public health, welfare, and safety during this public health crisis; and

WHEREAS, in order to address the aforesaid health and safety issue, the Township instituted a 9:00 p.m. curfew on juveniles applicable to the beaches to ensure that such social distancing requirements are enforced and to otherwise protect the public health, welfare, and safety during this public health crisis; and

WHEREAS, recent events have established that juveniles are now congregating in large numbers on the streets after 9:00 p.m. in a manner that violates the aforesaid social distancing requirements and in a manner that is detrimental to the public health, welfare, and safety during this public health crisis; and

WHEREAS, in order to protect the public health, welfare, and safety, as well as to protect the Township employees, the Township has elected to establish a Township-wide curfew applicable to juveniles not accompanied by their parents or legal guardians, as provided herein;

NOW, THEREFORE, in accordance with the aforesaid laws and recitals, which are incorporated herein by reference, it is promulgated and declared that until further Order of the Township that:

 

  1. Effective immediately and except as provided herein, all persons 17 and under shall not be permitted outside upon a public street, avenue, boulevard, place, walkway, alley, park, or any public area or unimproved private property located in the Township after 9:00 p.m. and until 5:00 a.m. the following

 

  1. Persons under 17 may be permitted outside in any public areas set forth above after 9:00 m. and until 5:00 a.m. the following day, provided they are accompanied by their parent or legal guardian.

 

  1. The Emergency Management Coordinator, the Township Police Department, and the Township Beach Patrol shall be charged with the enforcement of the terms of this Order; and

 

  1. Penalties for violations of this Order may be imposed under, among other statutes,

N.J.S.A. App. A:9-49 and -50, and the Township Code.
