Updated Emergency Order regarding Restaurants

AMENDMENT TO AN ORDER PURSUANT TO THE DECLARATION OF DISASTER AND EMERGENCY

TO ALL RESIDENTS AND PERSONS WITHIN THE MUNICIPALITY OF THE TOWNSHIP OF LONG BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY AND TO ALL DEPARTMENTS OF THE MUNICIPAL GOVERNMENT OF THE TOWNSHIP OF LONG BEACH

WHEREAS, pursuant to the powers vested by Chapter 251 of the laws of 1942, as amendedand supplemented, N.J.S.A. App. A: 9-30, et seq., N.J.S.A. 40:48-1, et seq., and all applicablestatutory law and regulations, as well as the Chapter 105 of the Township Code, the Township of Long Beach (“Township”) declared on March 24, 2020, that a local disaster/emergency exists within byand through the required authorization of the Director of Public Safety and the Emergency Management Coordinator; and

WHEREAS, the Township previously issued an emergency order that permitted and regulated certain outdoor dining and related services at restaurants, and, in furtherance of the purposes of that prior order, certain additional restrictions are adopted herein to ensure the public health, welfare, and safety.

NOW, THEREFORE, in accordance with the aforesaid laws and recitals, which are incorporatedherein by reference, it is promulgated and declared that until further Order of the Township, the following emergency restrictions and regulations are effective immediately.

  1. Effective immediately and continuing through October 1, 2020, the following regulations shall apply to all restaurants and outdoor dining: (i) outdoor seating at restaurants shall cease at 9:00 p.m. and all outdoor dining activities shall cease and close at 10:00 p.m.; (ii) any and all music relating to the outdoor dining activities shall be permitted only between the hours of 4:00 p.m. and 8:00 p.m.; and (iii) all takeout service shall cease at 1:00 a.m.
  • Each specific violation of this Order shall be considered a separate violation and theowners of restaurants shall be subject to potential multiple violations each day.
  • The Emergency Management Coordinator, the Township Police Department, and theConstruction Department shall be charged with the enforcement of the terms of this Order.
  • Penalties for violations of this Order may be imposed under, among other statutes,

N.J.S.A. App. A:9-49 and -50, and the Township Code and the temporary grant provided herein torestaurants may be revised or revoked by the Township.
